These Business Loan Finance Services Terms & Conditions (“Terms & Conditions”) apply in connection with any business loan funding application (“Request for Funding”) submitted by or on behalf of a business through CapitalPrimeCommercial.com (the “Site”).

As used herein, “CapitalPrimeCommercial.com” refers collectively to Capital Prime Commercial Funding Corp and its subsidiaries (“we,” “our,” or “us”). By submitting documentation for a Request for Funding, you (“Customer” or “you”) acknowledge and agree to these Terms & Conditions, which form part of CapitalPrimeCommercial.com’s Terms of Service and together constitute a legally binding agreement.

1. Information and Documentation

You represent and warrant that all information and documents provided (collectively, “Information and Documents”) are true, complete, and accurate.

Information may include, but is not limited to: credit reports, credit scores, credit history, investigative reports, bank statements, tax returns, credit card statements, and other personal or business records.

You authorize CapitalPrimeCommercial.com to provide such Information and Documents to banks, financial institutions, factors, funders, and other third-party funding providers (collectively, “Funders”) as deemed appropriate in our sole discretion.

You agree to promptly notify us of any changes in your financial condition or inaccuracies in the Information and Documents provided.

2. Credit Reports and Background Checks

You authorize CapitalPrimeCommercial.com and Funders to obtain personal and business credit reports, conduct background checks, and request investigative reports from credit reporting agencies, creditors, and financial institutions.

You authorize both hard and soft pulls of credit reports in connection with your Request for Funding and thereafter from time to time.

You waive and release any claims against CapitalPrimeCommercial.com, Funders, Funder Parties, credit reporting agencies, or related entities for any act or omission relating to the request, release, or use of such Information.

3. Use and Sharing of Information

You authorize CapitalPrimeCommercial.com and Funders to disclose, share, and retain Information and Documents with other parties involved in facilitating your funding request (“Funder Parties”).

You acknowledge that information provided may be retained and shared regardless of whether you ultimately receive funding.

You agree to directly notify any Funder if you no longer wish to receive communications from that Funder.

4. Limitations of CapitalPrimeCommercial.com’s Role

You acknowledge and agree that:

CapitalPrimeCommercial.com is not an agent or broker of the Customer or any Funder.

CapitalPrimeCommercial.com does not complete credit applications on behalf of Funders, issue credit decisions, or make loan commitments.

Any funding application is an inquiry to be matched with potential Funders.

Final credit decisions, terms, and approval remain at the sole discretion of the selected Funder.

Funders may require application fees for appraisals, credit reports, or related services.

5. Equal Credit Opportunity Act Notice

The federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (if legally able to contract), because income derives from public assistance, or because the applicant exercised rights under the Consumer Credit Protection Act.

6. Electronic Communications Consent

By using the Site and submitting a Request for Funding, you consent to conduct business with CapitalPrimeCommercial.com electronically, including email, e-signatures, and e-payments.

This website does not constitute an offer to make a loan or to extend credit on any specific terms. All rates and programs are for informational purposes only and may change without notice.

All applicants must:

Submit a written application and required documentation,

Meet underwriting requirements,

Satisfy all contingencies of loan approval, including appraisal and title review,

Maintain consistent financial condition until closing.

Certain loan products may not be available in all jurisdictions. Loan programs are subject to modification or discontinuation at any time.

In connection with an application, CapitalPrimeCommercial.com may act as a commercial loan broker and not as a lender. All programs are for business purposes only, and funding is limited to entities seeking commercial mortgage loans.
